Indiana judge allows school funding lawsuit to go to court

An Indiana judge has denied a motion by Governor Mitch Daniels to dismiss a lawsuit over the state’s school funding formula.  Hamilton Superior Court Judge Steven Nation says three school districts can sue the state over what they say is an unconstitutional way of funding local schools.  Those districts are Franklin Township, Hamilton Southeastern, and Middlebury Schools.  They say the current state funding formula penalizes schools with growing enrollment by giving more money to districts with declining enrollment.  Judge Nation denied five requests to throw out the lawsuit.  In response to the suit, State Attorney General Greg Zoeller has called on the legislature to prohibit schools from using state tax dollars to sue the state.
