Anderson challenges Lapel annexation in court

The city of Anderson is hoping a Madison County court will tell the town of Lapel that its recent annexation of land is against the law.
Anderson spokeswoman Charlee Turner says the city is asking Circuit Court 6 Judge Dennis Carroll to invalidate Lapel’s May annexation of 57 acres. The city says the annexation violated Indiana’s Home Rule Act. It says that not enough of the land directly borders the town of Lapel, which breaks the law. The annexed land in question runs south and east from Lapel to Pendleton, about three miles from Anderson.
Anderson Mayor Kevin Smith originally wanted to annex the land that Lapel – with the help of homeowners in the area — has claimed for its own. In March, the Anderson City Council vetoed the plan. Smith wanted to pitch a second smaller annexation plan in June, but most of the council did not attend a special meeting called to discuss the matter.
